Jury to decide if Ed Sheeran ‘copied’ Marvin Gaye’s hit song

A jury is set to decide whether Ed Sheeran copied Marvin Gaye’s hit ‘Let’s Get It On’ in his own track ‘Thinking Out Loud.’

The 27-year-old had previously requested to dismiss the lawsuit, but District Judge Louis Stanton in Manhattan has rejected his request.

Following the judge’s dismissal, a statement said that there were “substantial similarities between several of the two works’ musical elements” – which refers to the bass lines and percussion of both tracks.

The lawsuit will now be brought to a jury, who have to decide whether the 1973 classic’s rhythm is “too common” to deserve the copyright protection.

The lawsuit was filed by the estate of the late producer who co-wrote ‘Let’s Get It On’, and they named the defendants as Ed Sheeran, Amy Wadge, Atlantic Records and Sony/ATV Music Publishing.
